LESSEE (CUSTOMER)

1. Purpose of the agreement
- 1.1 The LESSOR rents to the LESSEE an electric mobility scooter for personal use during visits to parks, tourist areas and permitted locations in Florida.
- 1.2 The equipment remains the exclusive property of the LESSOR.
2. Rental period
- 2.1 The rental runs for the period selected in the booking (delivery and pickup dates and times).
- 2.2 The return must take place at the agreed time and location, otherwise additional charges may apply.
3. Price and payment
- 3.1 The LESSEE will pay the total amount shown in the booking for the contracted period.
- 3.2 In case of damage, the repair cost may be passed on to the lessee.
4. Lessee responsibilities
- 4.1 To use the equipment carefully, responsibly and only for its intended purpose.
- 4.2 Not to allow third parties to use the scooter without the LESSOR's authorization.
- 4.3 To be fully responsible for accidents, falls, collisions, injuries or damage caused to themselves or third parties during use.
- 4.4 Not to use the equipment under the influence of alcohol, drugs or medication that impairs motor coordination.
- 4.5 Not to modify, disassemble or attempt to repair the equipment.
- 4.6 To immediately report any malfunction, defect or accident involving the scooter.
- 4.7 To be responsible for loss, theft or total damage, bearing the replacement costs.
5. Lessor responsibilities
- 5.1 To deliver the equipment in good working and usable condition.
- 5.2 To provide basic operating and safety guidance.
- 5.3 To carry out regular preventive maintenance on the equipment.
- 5.4 To replace the equipment, when possible, in the event of a mechanical failure not caused by misuse.
6. Liability Waiver
- 6.1 The LESSEE acknowledges that use of the scooter involves inherent risks.
- 6.2 The LESSEE releases the LESSOR from any civil, criminal or financial liability for accidents, injuries, personal harm, or damage to third parties or property occurring during the rental period.
- 6.3 The LESSOR is not responsible for fines, warnings or penalties applied by parks or local authorities.
7. Use in parks and public places
- 7.1 The LESSEE acknowledges that each park has its own rules for the use of motorized scooters.
- 7.2 The LESSOR does not guarantee unrestricted access to attractions, lines or specific areas.
8. Termination
- 8.1 Failure to comply with any clause may result in immediate termination without refund.
- 8.2 Early return does not give rise to any refund, except by written agreement.
9. Governing law and jurisdiction
- 9.1 This agreement is governed by the laws of the State of Florida.
- 9.2 The courts of the county where the company is registered are elected to settle any disputes.
10. Acceptance
- 10.1 By checking the acceptance box and completing the booking, the LESSEE declares that they have read, understood and agree to all the terms, assuming full responsibility for the use of the equipment.
